Obstruction Clearances and Right of Way

On projects approved for COUNTY AND/OR CITY CONTRACTS, it will be the responsibility of the State Right of Way Engineer to
furnish appropriate certification, both on right of way and obstructions, to the Office of State Aid before preparation of
the contract is authorized. Therefore, the following procedure will be utilized on County and City Contracts:
- Upon receipt of the Commissioner's letter advising that the project has been approved, the District Engineer should
proceed immediately with certification of right of way and check the proposed project for any obstructions.
- All right of way certification, along with the obstruction clearance report, should be forwarded to the State
Right of Way Engineer by the District Engineer.
- The Right of Way Office will provide appropriate certification, both on right of way and obstructions, to the Office
of State Aid.
- Upon receipt of required certification, the Office of State Aid will authorize the preparation of the Contract for
execution by the County or City.
