Governor George Busbee issued an Executive Order on August 22, 1979 requiring that each state agency develop a policy
complying with the rules and regulations of Sections 1910.3, 1910.4 and 1910.5 of the National Flood Insurance Program.

It shall also be the Department of Transportation policy to comply with the Procedures for
Coordinating Highway Encroachments on Floodplains with Federal Emergency Management Agency (FEMA).

The policy of the Department of Transportation will be administered in-house. No additional permits will be required.
The Office of Road and Airport Design will be responsible for receiving and distributing copies of flood plain maps to be used in implementing these regulations. They will also receive and distribute new maps as they become available.
The requirements of this regulation and policy are effective immediately on affected projects.
The Chief Engineer has determined that the following type projects, by their nature, do not conflict with the National Flood Insurance regulations and no action is required.
The responsibility for insuring that proper consideration has been given affected projects will be as follows.
Location Phase. Office of Location is responsible.
If a portion of the project is located within a flood plain, feasible alternates will be considered and documented. In most Federal-Aid projects, this will be done as a part of the environmental assessment.
Design Phase. The Design Office having the actual design control, whether in General Office or District, will be responsible.
Basically, with few exceptions, structures (buildings) will be located outside of flood plains or will be designed according
to (c)(3) and (c)(4) of Section 60.3 of the National Flood Insurance Program. Bridges, fills and other drainage structures
will be designed so as to be in compliance with the "Procedures for Coordinating Highway Encroachments on Floodplains with
Federal Emergency Management Agency (FEMA)" and 23 CFR Part 650 subpart A - Location and Hydraulic Design of Encroachments
on Floodplains.

Notification of Other Agencies. Offices that now make application to the Corps of Engineers, the Coast Guard or the Water Quality Control Board for permits or approval will include in their application notice that the project is in a flood plain (if so) and that the design has met the requirements of the regulations.
Construction. District Engineer responsible. In the event that a habitable building is constructed in a flood plain, the District Engineer will certify the actual lowest floor (including basement) of the building, or if flood- proofing is utilized, the actual level of floodproofing in relation to National Geodetic Vertical Datum. The certification will be furnished to the Office of Engineering Services.
