Legal Actions Against the Department –
Service of Process

  1. Lawsuits and Legal Papers

    All actions brought against the Department shall be served on the Commissioner by leaving a copy in the Office of the Commissioner in the Department of Transportation Building at No. 2 Capitol Square, S.W., Atlanta, Georgia 30334 ( §32-2-5, O.C.G.A.). In addition to the Commissioner, service can only be accepted by the following individuals: Administrative Assistant to the Commissioner; Executive Assistant to the Commissioner; Special Assistant to the Deputy Commissioner; Secretary to the Commissioner and the Administrator of the Office of Legal Services. The Office of Legal Services will be responsible for forwarding all documents, as appropriate, to the Department of Law.

  2. Garnishments

    A summons of garnishment must be filed in the county of the office authorized to issue checks for salaries or in the county of the Chief Administrative Office of the agency as required by the Official Code of Georgia Unannotated, 18-4-21.

  3. Insurance Claims

    If any lawsuit or legal paper served upon the Department involved matters covered by insurance, then in addition to the procedures stated in Paragraph 1, above, a copy shall be forwarded to the Risk Management Office in the General Office of the Department. If there is any question as to whether an insurance claim is involved, contact the Risk Management Office by phone.

NOTE: It is essential that proper attention to the above be handled in a timely manner. If there is any question regarding the service of a legal document, the recipient should contact the Office of Legal Services.

This policy should be made known to all employees.
